Frank, it appears from the Review Panel's report that stakeholders in the insurance industry convinced the Panel that there was a need for a more extensive reporting process particularly when there was a significant amount of time between disclosure and the policy's inception. Hope that helps. Mark Sheller

Frank, thank you for taking the time to read and comment on my blog. Let me track the motivation down and I will get back to you. I know from the Explanatory memorandum that it was the Review Panel's idea that the notification requirements be changed. What I need to look into is what inspired (if I can use that expression) the panel. Mark

It is a long time since I wrote a text on insurance law. Prima facie the amendment is an example of the legislature creating more confusion for insureds and adding to insurers' costs. Was the amendment motivated by a court decision, some publicised anomaly, or some other good and compelling reason?

It will be interesting to see the level of activity with the PPS Register in 2012 and the business community's reaction to it. Will you be holding any seminars throughout the year to provide updates?

Thanks for those interesting links, Tony. A lot of US schools have been tackling these issues for longer than we have been. My sense is that US schools take sexting much more seriously partly because law enforcement authorities have been very active in this area, whereas the authorities here seem to have adopted a lower key approach.

Sorry to post again so soon but it occured to me after my initial post that the lack of policy referred to in the Seminar may well have been with respect to "sexting". Here is the link to an article about what a US school proposed in 2009 - note I could not find the policy in the Students Handbook at their website so do not know if the policy was ever put into place:

Not quite related to the question about 'will I lose my house" but definately related to the Independent Schools session on Legal Issues for School Leaders, which I attended. With reference to Cyberbullying my recollection is that few policies seem to be in existence in Victorian schools which cover this element of bullying. I came across an American school's policy, the link for which is: http://www.warwick.k12.pa.us/orgmodule.php?deptid=107&schoolid=0007&mid=248

Perhaps the content may be of some use?
